US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an mistake. Following his return to the United States to face alien smuggling charges, he was detained in federal custody.
In her decision, the judge noted that the government lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
